Tree Surgeons Vauxhall Terms and Conditions

Tree surgery team carrying out professional arboricultural workThese Terms and Conditions apply to all services supplied by Tree Surgeons Vauxhall and explain how bookings are made, how payment is handled, when cancellations may apply, and the limits of liability connected with tree surgery and related arboricultural work. By requesting a quotation, confirming a booking, or allowing work to begin, the customer agrees to these terms. They are designed to set out the practical basis on which our services are delivered, while remaining consistent with applicable UK law and industry practice.

For the purposes of these terms, references to “we”, “us” and “our” mean the service provider operating under the Tree Surgeons Vauxhall name, and “you” or “the customer” means the individual, property owner, managing agent, business, charity, or other organisation requesting the work. These terms apply whether the service relates to tree pruning, crown reduction, hedge trimming, felling, stump grinding, emergency call-outs, site clearance, or other tree surgery services agreed in writing or verbally.

Arborists assessing a tree before scheduled workAny estimate or quotation issued by Vauxhall tree surgeons is based on the information available at the time, including photographs, site notes, measurements, access assumptions, and any customer instructions. Unless expressly stated otherwise, quotations are valid for 30 days from the date issued. We reserve the right to revise any quote if site conditions, hidden defects, access restrictions, weather-related issues, legal requirements, or customer-requested changes materially alter the scope of work.

Booking Process

Bookings may be made after a quotation has been accepted and any required deposit has been paid. A booking is only confirmed when we issue written or verbal confirmation that work has been scheduled. No assumption should be made that a date is fixed until confirmation is provided. We may ask for details such as the location of the trees, access arrangements, parking restrictions, utility concerns, tree preservation status, conservation area considerations, and any known hazards that could affect the safe delivery of the job.

It is the customer’s responsibility to ensure that all information provided during the booking process is accurate and complete. If the customer is not the property owner, they must have the necessary authority to instruct the work. Where permission, consent, or approval is required from a landlord, freeholder, management company, local authority, or another third party, the customer must obtain it before work begins unless we have agreed in writing to assist with that process. Tree surgery services will not proceed where permissions are missing or clearly uncertain.

Tree surgeons managing waste and site safety proceduresWe may need to survey the site before work starts, particularly where large trees, access limitations, unstable ground, power lines, retained structures, or protected species may be involved. If a pre-start inspection is needed, the customer must provide reasonable access. Any delay caused by the absence of access, inaccurate information, or unavailable permissions may result in rescheduling charges or a revised price. We will always aim to be fair, but we are not responsible for avoidable delays caused by incomplete customer cooperation.

Scope of Service and Customer Responsibilities

All tree surgery work is carried out in accordance with agreed specifications, professional standards, and reasonable safety practices. The customer should understand that living trees are natural structures and outcomes can vary depending on species, age, health, previous pruning history, weather exposure, and site conditions. Unless specifically guaranteed in writing, we do not promise an exact regrowth pattern, future condition, or long-term structural outcome after pruning or reduction work.

The customer must ensure that the work area is reasonably clear and accessible. This includes moving vehicles, removing fragile items from nearby areas where possible, and informing us of underground services, hidden drains, boundaries, irrigation lines, animal enclosures, or any other special conditions. If we identify a risk during the job that was not disclosed beforehand, we may suspend work until the issue is resolved. If continuation would be unsafe, we may stop the service and charge for work already completed and any reasonable costs incurred.

Where agreed, we may undertake the removal of timber, branches, brash, or stump arisings. However, unless the contract says otherwise, waste remains the property of the customer until disposal arrangements are completed. Customers should not assume that all arisings, logs, chips, or stumps are included in the price. If the quotation mentions waste removal, it applies only to the categories expressly identified, and additional waste handling may be charged separately where necessary.

Payments

Payment terms will be stated in the quotation, invoice, or booking confirmation. Unless agreed otherwise, payment is due immediately upon completion of the work or within the period specified on the invoice. We may request a deposit for larger projects, emergency scheduling, specialist equipment, or where materials must be purchased in advance. Deposits are normally used to secure the appointment and cover administrative preparation. Any balance remaining after the deposit is payable once the service is complete.

We accept payment by the methods specified on the invoice or booking confirmation. If payment is not received by the due date, we reserve the right to charge interest and late payment fees to the extent permitted by law. We may also recover reasonable costs associated with collection, administration, or enforcement. Tree surgeons in Vauxhall may suspend future work, withhold certificates or completion notes, or decline further bookings until outstanding amounts are paid in full.

Any additional charges arising during the job, such as extra labour, equipment hire, traffic management, disposal fees, parking costs, or unforeseen access requirements, will be explained where practical before they are incurred. If immediate action is required for safety reasons, we may proceed to prevent damage or injury and then notify the customer of the cost afterwards. All prices are quoted in pounds sterling unless stated otherwise and may be subject to VAT where applicable.

Cancellations, Postponements, and Rescheduling

If the customer wishes to cancel or postpone a booking, reasonable notice must be given. Cancellations made well in advance may not incur a charge, but we reserve the right to retain all or part of any deposit where time has been reserved, planning has been completed, materials have been ordered, or equipment and staff have been allocated specifically for the job. The closer the cancellation is to the scheduled date, the more likely it is that a charge will apply.

If we must cancel or postpone due to weather, safety concerns, staff illness, equipment failure, traffic disruption, legal restrictions, or circumstances beyond our control, we will make reasonable efforts to rearrange the work at the earliest practical opportunity. We are not liable for indirect costs caused by such rescheduling, including temporary access inconvenience, missed appointments with third parties, or the customer’s own delay costs, except where the law requires otherwise.

Where the customer repeatedly cancels or refuses access after booking, we may require full or partial prepayment for future work. If a site is not ready on the agreed date, or if conditions on arrival make the job impossible to complete safely, we may charge a call-out fee or a wasted attendance fee. This helps cover the time, fuel, labour, and planning already committed to the appointment.

Waste Regulations and Environmental Handling

All waste generated by tree surgery work is managed in line with applicable UK waste law, including the requirement that waste is transferred only to authorised persons or facilities. We aim to reduce, reuse, and recycle arisings where practical, such as converting suitable timber to logs, wood chip, or other acceptable uses. However, the handling route depends on the material type, contamination risk, volume, and customer instructions, as well as any site-specific restrictions.

Tree surgeons services involving stump grindings, chipped material, logs, branches, and foliage may produce waste streams with different handling requirements. Some material may be left on site if agreed, while other material may need to be removed for licensed disposal. The customer must disclose any known contamination, including invasive species, disease, chemicals, Japanese knotweed-related material, or other regulated substances. If contaminated material is discovered, extra disposal charges may apply.

We may keep records of waste transfer, disposal arrangements, and relevant documentation where required by law or good practice. If the customer requests waste to be left on site, they accept responsibility for its onward management, storage, and lawful use. We do not accept liability for how waste is treated after it has been formally handed over to the customer, provided that handover was lawful and clearly agreed. Waste compliance may involve additional operational requirements and costs that are separate from the basic work price.

Liability and Limitations

Professional tree care team during a scheduled serviceWe will exercise reasonable care and skill when performing our services, but tree surgery involves inherent risks. Trees, branches, roots, and surrounding structures may behave unpredictably, especially where there is decay, storm damage, hidden defects, or unstable ground. While we take appropriate precautions, we are not responsible for pre-existing damage, latent defects, or outcomes that arise from the natural condition of the tree or site unless caused by our negligence or breach of duty.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded. Subject to that, we are not liable for indirect or consequential losses, loss of profit, business interruption, loss of enjoyment, or loss of use arising from the service. Our total liability for any claim arising from a booking will be limited to the amount paid or payable for the specific work giving rise to the claim, except where the law states otherwise.

Customers must notify us promptly of any issue they believe is connected to the work, and they should take reasonable steps to reduce further loss or damage. We may inspect any alleged defect or incident before liability is admitted or remedial action is arranged. If a claim is caused by inaccurate information provided by the customer, hidden hazards, third-party interference, poor site maintenance, or failure to follow agreed instructions, we may decline responsibility to the extent permitted by law.

Access, Safety, and Third Parties

For safety reasons, our team may need to exclude people, pets, and vehicles from the immediate work area. The customer must keep unauthorised persons away from the site while work is in progress. We may pause or stop operations if we believe conditions are unsafe, if children or animals enter the exclusion zone, if weather deteriorates, or if third-party behaviour interferes with safe working practices. Safety decisions made by our team on site are final until the risk has been addressed.

If work affects boundary lines, neighbouring property, shared access, or overhanging branches, the customer is responsible for ensuring that any necessary consent has been obtained. We may rely on the customer’s instruction where they assert they have the right to authorise the work. However, we do not accept responsibility for disputes between neighbours, landlords, tenants, freeholders, or other interested parties unless we have specifically agreed in writing to manage such matters on the customer’s behalf.

Tree surgeons completing work under UK service termsAny photographs, measurements, or records we create during the booking or service process may be used internally for operational, compliance, insurance, and quality-control purposes. They may also help us evidence the condition of the site before and after the work. If required by law or for defending a claim, we may retain relevant records for a reasonable period. We handle information in accordance with applicable data protection obligations.

Force Majeure and Governing Law

We shall not be liable for delays or failure to perform where the cause is beyond our reasonable control. This includes severe weather, storms, flooding, fire, accidents, road closures, civil disorder, strikes, shortages, power failures, equipment breakdowns, pandemics, changes in law, or instructions from emergency authorities. In such circumstances, we may suspend, rearrange, or cancel work without liability for resulting inconvenience, provided we act reasonably and communicate where practicable.

These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising in connection with the services, the quotation, the booking, payment, cancellation, or liability will be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory law provides otherwise. If any part of these terms is found invalid or unenforceable, the remaining provisions will continue in effect so far as legally possible.

Nothing in these terms affects your statutory rights as a consumer where applicable. If a matter is not expressly covered here, it will be interpreted in a fair and reasonable way consistent with UK contract law and the nature of professional tree surgery services. By engaging Tree Surgeons Vauxhall, you confirm that you have read, understood, and agreed to these terms as the basis for the work being carried out.
